Welcome to Outspeak. By accessing or using our website, applications, or services (collectively, the "Services"), you agree to these Terms of Service.

1. Your Account

• You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Services.
• You are responsible for safeguarding your account credentials and for all activity under your account.

2. Acceptable Use

You agree not to use the Services to create or distribute content that is unlawful, harmful, misleading, or infringes on the rights of others. Specifically, you may not:

• Impersonate individuals without consent or create deceptive content intended to mislead.
• Violate intellectual property rights, privacy rights, or publicity rights.
• Generate content that promotes violence, hate, or illegal activities.

We may suspend or terminate access if we believe a violation has occurred.

3. Content and Licenses

• You retain ownership of content you upload to the Services. You grant Outspeak a worldwide, non-exclusive license to host, process, and display that content solely to provide and improve the Services.
• You are responsible for obtaining all necessary rights and permissions for content you upload, including voices, images, and likenesses used for avatars and lip‑sync.

4. AI-Generated Content and Limitations

AI outputs can be incorrect or unexpected. You are responsible for reviewing outputs before use. We do not guarantee that generated content will be free of errors or suitable for a particular purpose.

5. Prohibited Uses: Voice and Likeness

You must not use voices, images, or likenesses of any person without proper authorization. When cloning or uploading a voice, you represent that you have the legal right to use it for the intended purpose.

6. Payments and Credits

Paid plans, usage-based fees, and credit allotments are described on our Pricing page. Charges may apply when you exceed included credits. Taxes may be added as required by law.

7. Privacy

Our Privacy Policy explains how we collect and use personal data.

8. Service Changes

We may modify or discontinue features at any time. If changes materially impact your use, we will provide reasonable notice.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTSPEAK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

11. Termination

We may suspend or terminate your access for any breach of these Terms. You may stop using the Services at any time.

12. Governing Law

These Terms are governed by the laws applicable in your place of residence or our principal place of business, without regard to conflict of laws principles.
